Philippe Bärtsch is a partner in Schellenberg Wittmer's International Arbitration Group in Geneva. He has extensive experience handling complex international commercial arbitrations.
He has acted as counsel in numerous international arbitration proceedings, both ad hoc
and institutional (e.g. ICC, LCIA, AAA/ICDR and Swiss Rules), involving a broad range of matters under many different laws. He has, for example, handled disputes relating to M&A transactions, construction and infrastructure projects, joint ventures, as well as sales, licence and distribution contracts. His clients are active in a wide range of industries, including in the energy, sports, telecommunications, pharmaceutical, construction, consumer goods and commodity trading sectors. He also sits as arbitrator.
He has successfully represented clients in setting aside proceedings before the Swiss Supreme Court. He regularly advises clients on the enforcement of arbitral awards and the drafting of arbitration clauses. He also advises clients on Swiss contract law issues as well as on international trade sanctions, including their impact on contractual obligations.
He is recognized in the leading legal directories such as GAR and Who's Who Legal. According to sources from GAR, he is praised "for his 'communications skills, both orally and in writing, consistent availability, attention to the changing circumstances of this litigation and ability to provide focused and detailed advice'." Who's Who Legal mention that he is "very knowledgeable" and "extremely able" according to peers.
He regularly speaks at conferences and publishes in international arbitration. He is a member of the Court of the Swiss Chambers' Arbitration Institution. He co-chairs Young Arbitration Practitioners (YAP), as well as the marketing committee of the Swiss Arbitration Association (ASA). In addition to being a member of several other professional associations (including the Geneva Bar Association, the LCIA and the Harvard Club of Switzerland), he is a member of the Academic Council of the Swiss Arbitration Academy.
He graduated from the University of Geneva Law School in 2000, receiving an award for the best law degree. In 2004, he obtained a Master of Laws (LL.M.) from Harvard Law School. He has been with Schellenberg Wittmer since 2001, except in 2006–2007 when he worked in New York in the arbitration group of a leading US firm.
