COVID-19 / Coronavirus
The world is taking extraordinary steps to fight and delay the spread of COVID-19. At Schellenberg Wittmer, we have taken the necessary steps to protect the health of our employees, our clients and the wider communities we work and live in. Most of our lawyers and staff now work remotely, but we remain fully available and reachable by phone (the normal phone numbers), email, fax and regular mail.

Obligation to contract based on relative market power

The Fair-Price-Initiative and the counter-proposal by the Federal Council will lead to new restrictions for companies with "relative market power", if other companies are dependent on them. The counter-proposal by the Federal Council would enable Swiss companies to purchase abroad at local purchasing conditions. Enforcement might, however, be difficult. While the implications of both proposals are significant, the effects of implementing the Initiative would go farther by covering Swiss domestic transactions as well.
