White Collar Crime and Compliance and Internal Corporate Investigations Partner Benjamin Borsodi was quoted in the Global Investigation Review's (GIR) July 2019 article entitled "Swiss blocking statute: The perfect catch-22."
In the analysis, which summarizes views by Swiss lawyers on enforcement of the country’s de facto blocking statute and foreign data request compliance, Benjamin discusses learnings from a recent Supreme Court case regarding companies obtaining permission from Swiss authorities before passing information on to foreign authorities. In addition, he discusses the mutual legal assistance treaty (MLAT) and waiver process, together with the issue of companies risking being sanctioned in Switzerland as a "catch-22".
