Schellenberg Wittmer Interviewed by ICT Journal on Technology Surveillance in the Workplace amidst Corona

14.05.2020

Roland Mathys and Michael Hess were invited by leading ICT publication "Netzwoche" (ICT Journal in French speaking Switzerland) to contribute their expert legal opinion on potential technology solutions employers in Switzerland may implement in the workplace, in regards to the return of employees and the maintenance of distance rules, amidst COVID-19.

In the article, Roland Mathys and Michael Hess comment on the implications of technology solutions and tools that employers are implementing to ensure safety in the office from a data protection and employment law perspective.

Legal opinions cover: A mobile application that polls employees daily about their health to assess the risk of coronavirus transmission; a network-compatible ring or smart bracelet that grants or denies access to company buildings or rooms, depending on the health of the employee (what in turn poses the question whether data collected by the smart device can be transmitted to the employer) and a video system with software to monitor compliance with distance regulations.
