Petitioner must demonstrate current interest in having award set aside

19.04.2016 – Case Number: 4A_620/2015 (1 April 2016)

The Swiss Supreme Court has rejected a petition to set aside an arbitral award on the ground that the petitioner lacked a "current, practical and concrete" interest in having the award set aside. The court noted that the petitioner, who already lacked a legitimate interest in the context of proceedings before the Court of Arbitration for Sport (CAS), had therefore, no "current" interest when challenging the CAS award before the Supreme Court. (Decision 4A_620/2015.)
