Practice Group

Schellenberg Wittmer's Administrative Law and Public Procurement Group advises in all legal matters related to public and administrative law, and supports companies in public procurement procedures. Our multidisciplinary team has long-term expertise across various sectors (e.g. energy, competition, regulatory, construction, environment, life sciences, healthcare, transport, media and telecommunications), and represents parties in administrative disputes before courts at a cantonal and federal level.

  • Extensive experience in all aspects of administrative proceedings, such as hearings and interrogations, on-site inspections, requests for information, access to files, admission and submission of evidence, liaising with external experts, document analysis and e-search, protection of business secrets, publication of decisions, etc.
  • Advice to national and multinational clients on regulatory aspects in various sectors (e.g. media, telecommunications, energy, construction, environment, life sciences, healthcare, food industry and transport)
  • Advice and support concerning compliance issues
  • Assessment of legal impact of new regulations, and support in planning and implementation of regulatory change
  • Dealing with public authorities on all aspects of administrative law related to public procurement
  • Provision of advice and support during all stages of procurement procedures, including drafting and review of tender notices and documents, and drafting and negotiation of procurement contracts
  • Representation of parties before the authorities and cantonal administrative courts, the Swiss Federal Administrative Court and the Swiss Federal Supreme Court
  • Representation of a substantial number of large Swiss energy producers and distributors in important cases in administrative law procedures concerning energy and grid tariffs, grid evaluation and transfer of part of the grid to the national grid operator swissgrid
  • Legal counsel to a major Swiss hospital group concerning a SAP software system, including contract review and assistance in implementation of the project which was running under public procurement provisions
  • Regulatory and corporate advice to a major global transport services corporation, in particular in the context of implementation of new local regulations in various cantons
  • Assistance to a large company providing property and facility management solutions in public procurement matters
  • Legal counsel to a major Swiss IT development firm and service provider in contract negotiations under public procurement law regarding a large software development project for road traffic authorities in Switzerland
  • Legal advice and support of a multinational healthcare company in public procurement procedures
