Our Real Estate Group assists our clients in performing the due diligence review and in drafting, negotiating, implementing and enforcing all types of real estate contracts. We advise on real estate related matters such as construction, environmental law aspects, tax and administrative matters, special rights and encumbrances on properties, and real estate owner’s liability. We have extensive experience throughout the Swiss real estate sector in both the commercial and the residential property markets.

We represent clients in contentious matters such as:

  • Adjudication, conciliation and mediation proceedings pertaining to post-closing disputes;
  • Litigation of post-closing disputes;
  • Litigation and arbitration of lease disputes;
  • Litigation of statutory liens disputes;
  • Litigation and arbitration of disputes relating to total work contracts, general work contracts and architect agreements.

Our experience includes:

  • Counsel to the Parker Hannifin group for the sale of its industrial contaminated site in Carouge, Geneva to Bricks Invest SA, on which a major residential and office development is planned in the area of Praille Acacias Vernet;
  • Counsel to Rockspring Property Investment Managers for the legal and tax due diligence, as well as for the negotiation, drafting and signing of a SPA concerning the entire share capital of a Swiss company owning land in the Canton of Geneva, on which the construction of a major industrial development was authorized;
  • Counsel to a large international oil trading group in the negotiation, drafting and signing of a complex commercial lease concerning more than 3’000 sqm of office premises in the CBD of Geneva (and 50 parking spaces in the basement of the building) to be used for the new headquarters of the client in Geneva;
  • Counsel to Foncia Group, a European leader in residential property management in the negotiation, drafting and signing of a sale and purchase agreement concerning all shares of Groupe MK, a real estate services company principally active in the canton of Vaud. We additionally advised Foncia Group in the negotiation, drafting and signing of a sale and purchase agreement concerning all the shares of Brolliet Holding SA and Brolliet SA, one of the oldest and most important real estate groups in Geneva;
  • Assistance to a private owner of a mixed use property situated in Geneva to terminate the lease agreement of tenants who were proposing to rent the apartment on Air bnb. We then negotiated the sale of the building to a Swiss fund in the course of a private bidding process.
  • Advise to Barana Group in the sale of the landmark building "Airgate" in a multi-tier auction process to the city of Zurich. We advised on all structural, legal and tax aspects;
  • Counsel to SV Group AG on the conclusion of four long-term lease agreements for hotel projects in multiple German cities. This involved complex negotiation with the property owners and the franchisor;
  • Advice to Celgene group in the mixed real estate and asset acquisition of a strategically important leasehold property including installations and equipment at the Siegfried pharmapark;
  • Counsel for the negotiating and signing of the architect agreement, interior design agreement, work contracts as well as the loan agreement for the construction of a landmark rooftop bar and lounge in Hotel Beaulac in Neuchatel;
  • Advice to the owners of an office and retail property located on Rue Du Rhone in Geneva for the negotiation and signing of a complex retail lease with Activ Fitness AG – for a new high-class fitness and wellness center.
