  • Merger Control: We assist in a variety of complex merger control proceedings in Switzerland and coordinate international notifications;
  • Investigations: We represent clients in competition law investigations by the Swiss competition authority, with special expertise in representing parties in dominance and distribution cases (luxury goods, electronics, print media and television, telecommunication, electricity, payment cards, retail etc.);
  • General Competition Advice: We advise both national and multinational corporate clients on competition law regarding exclusive and selective distribution agreements as well as licensing agreements (luxury watches, pharmaceuticals, technology, communication, media, financial and insurance services etc.);
  • Leniency: We handle national and international leniency procedures;
  • Dawn Raids: We assist with respect to dawn raids by the Swiss competition authority;
  • Compliance: We provide compliance programs, training, e-learning, and audits for Swiss and international clients;
  • Internal Investigations: We handle complex internal investigation processes in the context of competition law investigations;
  • Arbitration: We cooperate with the arbitration and litigation team on aspects of competition law in arbitration cases;
  • Related Areas: We handle telecom and energy regulatory assignments, health care procedures, public procurement matters and investigations by the Swiss Price Supervisor (Preisüberwacher, Surveillant des Prix).

Our experience includes:

  • Counsel in the merger control aspects in the recent merger of TWINT AG (PostFinance) and Paymit (SIX), creating the leading Swiss mobile payment solution TWINT 2.0, together with the six biggest Swiss banks, including UBS, Zürcher Kantonalbank, Credit Suisse, PostFinance, Raiffeisen, and Banque Cantonale Vaudoise;
  • Counsel to Goldman Sachs Merchant Banking Division and Altor Fund IV in the Swiss merger control procedure for the acquisition of joint control over Navico Holding AS, a leading provider of marine electronic;
  • Representation of Credit Suisse in investigations by the Swiss Competition Commission;
  • Advice to Husqvarna in an investigation by the Swiss Competition Commission regarding resale prices of a product. The team was able to limit the procedure to certain types of behavior and negotiate a favorable settlement.
