Our experience includes:

  • Successful defense of UBS before the cantonal courts and the Swiss Federal Tribunal against a large claim brought by an institutional client for losses suffered in connection with the 2008 financial crisis;
  • Lead counsel in the defense of a Swiss industrialist prosecuted for alleged intentional disaster caused by asbestos-cement factories several decades ago and acquitted by the Italian Supreme Court;
  • Representation of the Russian Federation in Swiss Supreme Court proceedings relating to setting-aside of an award on jurisdiction in an investment arbitration matter. Schellenberg Wittmer acts as lead counsel in the Swiss proceedings;
  • Representation of Hungary before the Swiss Supreme Court in setting-aside proceedings of an arbitral award rendered by an arbitral tribunal constituted under the Energy Charter Treaty (ECT). The decision is published in the hard-copy collection of Swiss Supreme Court decisions;
  • Representation of a telecommunication company in a post M&A dispute, where the opposing side failed to pay the last part of the purchase price. After a long-fought battle, during which we successfully seized assets of the opposing side in several jurisdictions, we are able to secure a very favourable settlement for our client, obtaining 95% of the amount of our client's claim and recovery of all costs, including lawyers' fee;
  • Defence of Gazprom Neft against a corporate liability claim brought by the European Bank for Reconstruction and Development (EBRD). This matter concerns civil litigation that has been brought to the Swiss Courts;
  • Lead counsel to a major Swiss bank against damages claims of private parties (victims) based on money laundering allegations in connection with an international fraud scheme, and in OAG criminal investigation;
  • Counsel to a Germany-based industrial plants construction company in a dispute and arbitration against a France-based multinational group in nuclear power and renewable energy in connection with a nuclear power plant project in Germany.
